Terms & Conditions

By accessing or using the KUERII platform, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use our services.

• Acceptance: Your use of the platform constitutes acceptance of these terms and all applicable policies.
• Eligibility: You must be at least 18 years old and have the legal authority to enter into binding agreements.
• Account responsibility: You are responsible for maintaining the security of your account credentials and for all activities under your account.

KUERII grants you a limited, non-exclusive, non-transferable license to access and use the platform in accordance with these terms.

• License grant: A revocable, non-sublicensable right to use the platform for your internal business purposes during the subscription term.
• Usage restrictions: You may not reverse engineer, decompile, or attempt to extract the source code of the platform. Automated scraping or data harvesting is prohibited.
• Intellectual property: All content, technology, and branding on the platform remain the exclusive property of KUERII. Your data remains yours.

Both parties agree to maintain the confidentiality of proprietary information exchanged during the course of the relationship.

• Data handling: Your data is processed in accordance with our Privacy Notice and applicable data protection regulations.
• NDA provisions: Confidential information shall not be disclosed to third parties without prior written consent, except as required by law.
• Information protection: We employ technical and organizational safeguards to protect confidential information from unauthorized access.

Subscription fees are based on the plan you select. All prices are quoted in USD unless otherwise stated.

• Pricing: Fees are as set forth in the applicable order form or pricing page. KUERII reserves the right to adjust pricing with 30 days prior notice.
• Billing cycles: Subscriptions are billed monthly or annually in advance. Invoices are issued at the start of each billing period.
• Refund policy: Annual subscriptions may be eligible for a pro-rated refund within the first 30 days. Monthly subscriptions are non-refundable.

To the maximum extent permitted by applicable law, KUERII's total liability shall be limited as follows:

• Liability caps: Our aggregate liability shall not exceed the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim.
• Exclusions: We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data loss.
• Indemnification: You agree to indemnify KUERII against any claims arising from your misuse of the platform or violation of these terms.

KUERII reserves the right to update or modify these terms at any time. We will notify you of material changes in advance.

• Right to modify: We may revise these terms to reflect changes in our services, legal requirements, or business practices.
• Notification procedures: Material changes will be communicated via email and/or a prominent notice on the platform at least 30 days before they take effect.
• Continued use: Your continued use of the platform after changes take effect constitutes acceptance of the revised terms.

These terms are governed by the laws of Mexico. Any disputes shall be resolved through the mechanisms described below.

• Governing law: These terms shall be governed by and construed in accordance with the laws of Mexico.
• Dispute resolution: Disputes shall first be submitted to mediation. If unresolved, they shall be settled by arbitration in Mexico City.
• LFPDPPP compliance: We comply with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP) and its regulations for the protection of personal data.
